Funding your medical negligence claim

We carry out many of our medical negligence claims on a no win, no fee basis. This means there are no upfront costs for you and, provided that you are honest throughout and do not abandon your claim against our advice. There will be no financial risk to you – even if your claim is not successful.

In most instances we will purchase ‘After the Event’ (ATE) insurance on your behalf to cover any legal costs should you not win the case. However, if you have a ‘Before the Event’ (BTE) insurance policy included in your home, car or credit card insurance then we may look to use that insurance to cover the legal costs and an ATE policy should not then be required.

Who pays my legal costs?

If we are successful in your claim for compensation, then the majority of your legal costs will be met by those responsible for your medical injury or illness, and this liability is often covered by an insurance company. The Agreement states that a success fee (capped at a percentage of your damages), which we will agree with you in the beginning, will be deducted at the conclusion to contribute to the work that we have done for you. You will also have to pay part of the ATE Insurance if you win. You do not have to pay for the ATE if you do not win your case.

Funding your personal injury claim

We are usually able to offer no win, no fee agreements (also known as Conditional Fee Arrangements (CFAs)) to our personal injury clients. In ‘no win, no fee’ agreements there are no up-front costs for you and if you don’t win, we don’t get paid.

In most cases we will arrange ‘After the Event’ (ATE) insurance on your behalf to cover expenses such as court and expert fees and any legal costs awarded against you should you lose your claim. However, if you have a ‘Before the Event’ (BTE) insurance policy included in your home, car or credit card insurance then we will look to use that insurance to cover the legal costs and an ATE policy should not then be needed

What happens when I win my case – who pays the costs?

When we win a claim, some of your legal costs are likely to be paid by those responsible for your injury or illness, and this liability is often covered by an insurance company. Our agreement with you will usually state that a percentage of your compensation, which we will agree with you at the outset, will be paid to us to contribute to the work that we have done for you. We will also charge a success fee for taking the risk of not being paid if the claim isn’t successful. For certainty we will give a guaranteed cap as to the percentage of compensation that we will charge.

Financial support for serious injury patient

Where appropriate, we will seek to secure early payments to help people where they are suffering financial hardship, to fund rehabilitation and to assist with employment issues.

We are also able to arrange trusts to ensure that benefits are protected and offer assistance with any court of protection issues, for those who are unable to manage their own financial affairs following their accident.

Funding your inheritance disputes claim

Our inheritance dispute lawyers are happy to discuss fee options with you – there are a number of possible options.

No win, no fee basis

We do act on a conditional fee basis (sometimes referred to as a “no win no fee”) for certain cases (mostly Inheritance Act 1975 Act claims).

What other funding options do you offer?

The majority of our clients pay us on the basis of the time spent on the matter on the basis of our agreed hourly rates. Sometimes, where appropriate, rather than being paid as the case goes along, we will agree to be paid at the end of case, in return for an additional charge. Some clients may have the benefit of legal expenses insurance which can cover the legal costs of bringing such claims. Often legal expenses insurance is available through a client’s car insurance, home insurance or part of a packaged bank account. However, not all policies cover inheritance dispute claims and any cover may be limited. There is now also the option of obtaining a loan from a third party lender to fund the dispute which is secured against the expected inheritance.

We can be instructed via a standard retainer at our hourly rate (rates dictated by fee earner level). This may be preferable to a CFA depending on your individual circumstances, as a CFA carries success fees. In addition to working with existing legal expenses insurance policies, such as household insurance, we can also explore options with After the Event insurers and where appropriate litigation funders.
