Will I have to attend an inquest following a stillbirth?

Before a coroner can legally begin investigating a death under this jurisdiction, there needs to have been proof of ‘independent life’ before the death. Unfortunately this can’t be proven in the case of stillbirths, meaning coroners are not legally allowed to investigate them under the jurisdiction of England, Wales and Scotland.

As solicitors, we have had instances where a client has asked for a formal inquest after a stillbirth. We can apply for this on your behalf, but you will be asked to attend as a witness.
