No Win, No Fee

We understand you have questions around legal fees and how these are paid, and by whom. If we are successful in claiming compensation on your behalf, then the majority of your legal costs will be met by those responsible for your medical injury or illness, and this liability is often covered by an insurance company. The agreement states that a success fee (capped at a percentage of your damages), which we will agree with you in the beginning, will be deducted at the conclusion of your claim to contribute to the work that we have done for you. You will also have to pay part of the ATE insurance if you win. You do not have to pay for the ATE if you do not win your case.

No win, no fee agreements are also known as Conditional Fee Agreements (CFAs) and mean that if your claim is unsuccessful, you will not be asked to pay for any legal costs that might have been incurred during your claim. Any third-party costs (court fees etc) will be recovered under an ATE policy (as mentioned in the response above). We usually purchase ATE insurance on your behalf to cover these costs if you do not win your case. If you win your case under a no win, no fee agreement, the fees will be covered by those responsible for what happened to you (usually under an insurance arrangement), as stated above.

The idea of a no win, no fee agreement is to protect you from any financial risk. As long as you are honest throughout your claim and don’t act against the advice we give you, you will be risk-free. The only time you will be expected to pay anything, is if your case is successful and you incur a success fee (which will be deducted from your total compensation amount and agreed with you at the beginning of the claim).
