Our client Jodi has settled her surgical negligence claim after enduring months of unnecessary pain, medical complications and an unnoticed serious burn following surgery for pelvic organ prolapse.

Timeline of events

In spring 2021, Jodi underwent a vaginal hysterectomy and pelvic floor repair at a private healthcare provider, hoping to resolve the symptoms of pelvic organ prolapse and bladder dysfunction that had affected her for years.

In the days that followed her surgery, however, Jodi developed a severe burn injury in the area affected by the surgery, which went unnoticed by the surgical team at the time. Her pain and discomfort were dismissed as part of the normal post-operative recovery process. Despite the severity of the injury, Jodi’s symptoms were not properly investigated, and no treatment plan was put in place to address the worsening condition caused by surgical negligence.

Over the next few days, Jodi also began experiencing significant urinary retention. Her catheter was removed prematurely, and there was no follow up to ensure her recovery was progressing as expected. Her medical team failed to monitor her closely, and she was left to deal with prolonged pain from both her burn injury and bladder complication.

By early summer, after several attempts to manage her condition, Jodi required regular dressings and her bladder issues persisted – significantly affecting her quality of life.

How we helped Jodi’s surgical negligence claim

After reviewing Jodi’s medical records and consulting with independent experts, it became clear that the healthcare provider had failed in several areas of her care.

The burn injury was likely the result of inadequate surgical technique or post-operative management. Furthermore, Jodi’s ongoing bladder retention and lack of follow up care only worsened her condition. These avoidable mistakes compounded her physical and emotional pain, leading to a significantly prolonged recovery period.

Our team investigated Jodi’s case and through careful negotiation and advocacy, we were able to settle the claim out of court, ensuring that she received compensation for her pain, medical expenses, and the emotional toll of her extended recovery.

A note from Natalizia Capizzi

“Jodi’s story is deeply distressing and the prolonged suffering she endured could have been entirely avoided with proper post-operative care. The failure to properly monitor and address her symptoms led to a severe burn injury and a prolonged recovery that affected her physically and emotionally. We are grateful to have been able to help Jodi and her family through this difficult time and to have achieved a settlement that acknowledges the profound impact of these failings on her life.”
