From trauma to triumph: John's £3.5M settlement journey

John suffered a severe traumatic brain injury in a road traffic incident, resulting in significant cognitive decline, Organic Personality Disorder, and other physical injuries including a spinal fracture, vestibular dysfunction, deafness in one ear, and a fractured leg. Through privately funded rehabilitation secured under the Rehabilitation Code, John made excellent progress in his recovery. However, due to personality changes and memory decline, he was unable to return to his senior executive role.

The case primarily focused on John's potential career trajectory had the incident not occurred and the diagnosis of Organic Personality Disorder. Efforts were made to gather supportive evidence from former colleagues regarding his career prospects. Both parties obtained expert evidence from forensic accountants and employment consultants to narrow the issues. Following a joint settlement meeting, John's personal injury claim was settled for £3.5 million, several months before a scheduled 10-day trial at the Royal Court of Justice.

A toddler's journey to pioneering care

Verity, a 20-month-old child, suffered a severe hypoxic brain injury after being trapped under a reversing car driven by her father during a family camping holiday. The incident left her with cerebral palsy, spastic dyskinetic quadriplegia, severe learning difficulties, communication problems, scoliosis, drug-resistant epilepsy, and the need for lifelong tube feeding. Due to the sensitive nature of the case, an anonymity order was extended to both the client and the defendant.

Lime Solicitors secured a record-breaking £600,000 annual interim payment, enabling a comprehensive private rehabilitation package for Verity. The case settled for approximately £20 million, including one of the top five periodical payment orders on record at £600,000 per annum. Notably, the settlement included a unique reverse indemnity to ensure continued care beyond the predicted life expectancy of 25 years. The legal team successfully argued for a full-time employed nurse and maintained involvement of the Clinical Commissioning Group, demonstrating a collaborative approach between statutory and private services to maximize Verity's quality of life.

Pregnant crash survivor's £2.75m settlement

Thea, a 27-week pregnant woman, suffered a brain injury and crush injuries to her lower limbs in a road traffic collision caused by a lorry driver texting while driving. While in intensive care, she developed lipoedema, a rare skin disorder. This case is believed to be the first to establish a causative link between trauma and the onset of lipoedema, making it particularly complex. Thea spent 11 weeks in hospital and underwent 13 surgeries during the course of her claim.

Lime solicitors acted on Thea's behalf, implementing a private rehabilitation package to support her needs while investigating the causation issues surrounding her condition. Despite initial challenges with the defendant's insurers, the legal team secured a significant interim payment of £500,000 to fund rehabilitation and compensate for lost earnings. This enabled Thea to make substantial progress in physiotherapy, neuropsychology, and day-to-day living with the support of a case manager and care team. The case ultimately settled for £2.75 million at a joint settlement meeting, highlighting the importance of ensuring continuous support and treatment to maximise the client's recovery.

Brain injury FAQs

We can help if a brain injury occurred in the workplace. A blow to the head at work can sometimes cause an injury to the brain. It is known as the hidden disability and often the effects are not obvious. A person is admitted to hospital with a head injury every three minutes in the UK.
We understand that when someone sustains a traumatic brain injury, it will have a big impact on all aspects of their life and the lives of their families. We passionately believe that our role as brain injury lawyers is to secure the best possible future for our clients and their loved ones.
If you or a loved one think you may have a brain injury claim, please don’t hesitate to contact our team. We’ll chat to you about your situation, and will be able to advise on the next steps.
Generally, the damages you’d expect to be covered in your compensation would be made up of the following, depending on your individual circumstances:
  • General damages – for pain, loss of amenity, suffering.
  • Special damages – to cover any medical expenses, loss of earnings, travel to hospital etc. This also includes rehabilitation and home adaptations.
Like with any personal injury claim, you have three years less one day from the date of your injury to bring a claim. If you are making a claim for a head injury sustained in a criminal attack, you have two years from the incident. A minor (child under the age of 18) has until their twenty-first birthday to pursue a claim for a head injury.
You have the right to change your legal advisor if you are unhappy with their service. We are happy to provide a no-obligation second opinion about your claim if you are not sure about the direction it is taking. If you do require a second opinion with a view to changing solicitors, we recommend that you do so sooner rather than later to minimise any damage being done with respect to your claim.
Disclaimer

In general you have three years from the date of injury or reasonable knowledge of injury to bring a compensation claim. There are some exceptions to this rule for instance where the matter involves a child in which case the child has three years from the date of their 18th birthday to bring a claim, therefore expiring on the individual’s 21st birthday.

It is important to speak to a legal team as early as possible to avoid any issues with limitation dates.
