It is normally used to treat pain and stiffness in the knee joint caused by osteoarthritis. Your claim is made against the specific NHS Trust that runs the hospital where the negligence occurred, the payment is not directly taken from that Trust’s budget. However, in England, claims are paid for by NHS Resolution, which is the insurer for the NHS. The individual NHS Trusts pay an annual premium to NHS Resolution, regardless of whether they have claims in that year. Therefore, a successful claim doesn’t directly reduce the funding available for other patients or services at the specific hospital.
This will depend entirely on the injuries that you suffer and the ongoing effect of those injuries on you. Therefore, very serious claims can be worth millions whereas less severe injuries may be only worth a few thousand pounds. It always depends on the injury not upon the nature of the negligent treatment you receive. You are compensated for your injuries rather than the Defendant being punished for its negligence.

In general you have three years from the date of negligence or reasonable knowledge of mistreatment by a medical professional causing you harm to bring a medical negligence compensation claim. There are some exceptions to this rule; for instance where the matter involves a child in which case the child has three years from the date of their 18th birthday to bring a claim, therefore expiring on the individual’s 21st birthday.
